Capital One Data Breach Settlement

Capital One settled allegations that a criminal cyberattack on its systems let the attacker gain unauthorized access to the personal information of approximately 98 million U.S. consumers. Capital One denies any wrongdoing and the court made no finding of liability.

A settlement resolving a class action over the 2019 Capital One cyberattack. The claim filing period is closed: the deadline to file a claim for Lost Time or Out-of-Pocket Losses was September 30, 2022, and payments to claimants were issued beginning on September 28, 2023. Free Identity Defense and Restoration Services remain available to Settlement Class Members through February 13, 2028.

The settlement website does not publish a class definition. It states that all Settlement Class Members, including those who did not enroll in Identity Defense Services and those who did not submit a claim, may use the free Restoration Services offered through Pango until February 13, 2028.
