EFS Advisors and Aviben Data Security Incident Settlement

EFS Advisors, LLC settled allegations that an unauthorized third party attempted to access its computer network and that of Educators Benefit Consultants, LLC d/b/a Aviben, detected on or about February 22, 2024, during which the unauthorized actor may have accessed impacted individuals’ Private Information. EFS Advisors, LLC denies any wrongdoing and the court made no finding of liability.
A proposed settlement of Kennedy, et al., v. EFS Advisors, LLC, et al., over an unauthorized attempt to access the computer network of EFS Advisors, LLC and Educators Benefit Consultants, LLC d/b/a Aviben, detected on or about February 22, 2024. Settlement Class Members can claim credit monitoring and a cash payment by October 22, 2026.

Who is eligible?
All living individuals in the United States whose Private Information was potentially accessed in the Data Security Incident. Directors, officers and agents of the Defendants, governmental entities, and the Judge assigned to the case, the Judge’s immediate family and Court staff are excluded.
How do you get paid?
Settlement Class Members who submit a timely and valid Claim Form may claim one year of three-bureau credit monitoring and one Cash Payment option: compensation for documented, out-of-pocket unreimbursed losses fairly traceable to the Data Security Incident, or a one-time Alternative Cash Payment. The official settlement website lists the cap for each option, and individual cash payments may be reduced pro rata if claims and costs exceed the settlement’s overall cap.
What proof do you need?
Claims for documented out-of-pocket losses require reasonable documentation, such as receipts, credit card statements, bank statements, invoices or telephone records; self-prepared documents such as handwritten receipts are, by themselves, insufficient.
