Kroger Savings Club Prescription Pricing Settlement

The Kroger Co. settled allegations that it inflated its usual and customary (U&C) prices by not considering the prices it charged under its Savings Club in determining the U&C price, resulting in insured customers paying inflated amounts for prescription drugs. The Kroger Co. denies any wrongdoing and the court made no finding of liability.
A proposed settlement of Kirkbride et al. v. The Kroger Co., a class action over Kroger’s usual and customary (U&C) pricing practices, on behalf of individuals who paid for one or more prescription drugs at Kroger using their insurance. Claim Forms are due by December 21, 2026.

Who is eligible?
Individuals in the United States and its territories who, during the Settlement Class Period, paid in whole or in part for one or more prescription drugs from Kroger using their insurance. Judges and their staff, Kroger’s officers and directors and affiliated entities, people who request exclusion, and people who have already sued, filed an arbitration demand or participated in a settlement against Kroger over its Savings Club U&C pricing are excluded.
How do you get paid?
A share of the Net Settlement Fund, distributed under a Plan of Allocation and Distribution. The amount depends on how much you, and other members of the Settlement Class, paid in whole or in part during the Settlement Class Period for prescription drugs bought from Kroger where prescription insurance benefits were used.
What proof do you need?
Claims where the total amount claimed is $8,000 or more require supporting documentation sufficient to identify the individual’s payments to Kroger during the Settlement Class Period.
