OneTouchPoint Corp. settled allegations that a cybersecurity incident it suffered in April 2022 resulted in potential compromise of the Private Information of current and former patients or subscribers of its clients and of its employees. OneTouchPoint Corp. denies any wrongdoing and the court made no finding of liability.

A settlement resolving a class action over a cybersecurity incident suffered by OneTouchPoint Corp. in April 2022 that resulted in potential compromise of the Private Information of current and former patients or subscribers of OTP’s clients and of OTP employees. Monetary Settlement Class Members can claim reimbursement of losses, payment for time spent, or an alternative cash payment, plus credit monitoring.

Who is eligible?

The “Monetary Settlement Class”: All persons in the United States and its territories whose Private Information was determined by OTP’s investigation to have been impacted in the Data Incident in or about April 2022, as well as those named as plaintiffs in the Lawsuit and/or this Litigation. People who were sent notice by OTP but for whom the impact could not be confirmed belong to the Injunctive Relief Settlement Class and cannot claim money.

How do you get paid?

Monetary Settlement Class Members may claim compensation for Ordinary Losses, capped at $500 per Claimant; compensation for Extraordinary Losses, capped at $5,000 per Claimant; and compensation for Time Spent at $25 per hour, for a maximum of four hours ($100 maximum). In lieu of those three, they may elect to receive a one-time $75 payment without the need to document losses or attest to time spent. They may also elect a two-year membership of one-bureau credit monitoring. Injunctive Relief Settlement Class Members cannot file claims for monetary compensation or credit monitoring.

What proof do you need?

Submit a valid Claim Form, online using the Claim Number and PIN found in the email or postcard notice, or by mail. Extraordinary Losses must be proven monetary losses; Time Spent requires an attestation of time spent responding to the Data Incident. All Claim Forms will be reviewed by the Settlement Administrator for completeness and plausibility.
